Will Novartis’s India Setback Bother These Top Institutional Shareholders?

India’s top court has dismissed Swiss drugmaker Novartis’s (NYSE:NVS) attempt to win patent protection for its cancer drug Glivec, which is a blow to Western pharmaceutical firms that have been targeting India to drive sales, but it is a victory for local makers of cheap generics, Reuters reported. This decision is a benchmark for intellectual property cases in India, where a large number of patented drugs are unaffordable for the majority of the country’s 1.2 billion population, and it does not look good for foreign firms that are engaged in ongoing disputes in India, which includes Pfizer (NYSE:PFE) and Roche Holding AG, analysts reported. Among the chief beneficiaries of Monday’s Supreme Court ruling are to be India’s Cipla and Natco Pharma Ltd, which have already been selling ‘generic’ Glivec in India at about one-tenth of the price of the branded drug.
