New York State Supreme Court judge Justice Jeffrey K Oing requested that retailers Macy’s (NYSE:M) and J.C. Penney (NYSE:JCP), and home merchandise company Martha Stewart Living Omni Media (NYSE:MSO) participate in mediation proceedings and “find some common ground” prior to resuming the trial for hearing on April 8. In fact, the judge also asked that Martha Stewart and Macy’s chairman Terry Lundgren speak to discuss the dispute, which they have done. In January 2012, Macy’s sued Martha Stewart’s company, and J.C. Penney also sued only a few months later, objecting to their December 2011 deal whereby J.C. Penney would sell Martha Stewart items in new mini-stores. Macy’s argued that it possessed exclusive rights to sell items like bedding and cookware, and that it built up Martha Stewart’s brands after 2005. The retailer accused J.C. Penney of attemptin to take advantage of Macy’s work.
