Health Management Associates, Inc. (NYSE:HMA): Most of the healthcare reform law, including the insurance mandate, has been ruled by the Supreme Court to be constitutional. In a 5-4 decision, the Court determined that, Constitutionally, Congress’ taxing power has authority to put the mandate in place. The five justice who voted in favor of the law say its penalty for not purchasing health insurance is a tax. The majority determined that the law’s extension of Medicaid is constitutional, but states that do not opt to meet its Medicaid requirements oughtn’t be kept from all their Medicaid funding. Rather, these states can only be kept from new Medicaid funding. The majority of large insurance companies dropped after the court’s ruling, as the law includes provisions that restrict profits of insurers at the same time as imposing expensive mandates on them. However, hospital stocks are rising as the mandate will most likely help them get more revenue from poor patients.
